Betting regulations: what does Ordinance 827/2024 say?
On May 22, 2024, the Prize and Betting Secretariat (SPA) of the Ministry of Finance (MF) published Ordinance SPA/MF No. 827/2024. The aim is to establish rules and conditions for obtaining authorization for the commercial exploitation of fixed-odds lottery betting by private economic agents throughout the country.
The rule establishes the procedures required to obtain authorization from the MF to operate popular sports betting in Brazil. In addition, it takes into account the guidelines and general rules of betting regulation established by Federal Law No. 14,790/2023.
The SPA’s initiative will allow new entrants to provide this type of lottery and will regularize the legal entities that already operate the activity. For this reason, the rule is widely expected by economic agents interested in starting the activity.
In addition to the rules and criteria for obtaining authorization, Ordinance SPA/MF No. 827/2024 is also made up of several annexes, which include models and guidelines to be followed by the legal entities applying, with the aim of facilitating the authorization process, including draft applications, declarations and forms to be filled in.

What is the deadline for obtaining authorization from the SPA to regulate betting?
Legal entities in activity when the betting regulation is published as of Law No. 14,790/2023 must obtain authorization by December 31, 2024. Therefore, as of January 1, 2025, the operation of fixed-odds betting without authorization subjects the legal entity to penalties.
For legal entities that apply for authorization within the first 90 days from the date of publication of Ordinance No. 827/2024, the authorization must be granted by the SPA until December 31, 2024, provided that all legal and regulatory requirements are met.
Interministerial Ordinance No. 28/2024
Published on May 23, 2024 and drawn up by the Ministry of Finance, the Ministry of Sport and the Federal Attorney General’s Office, Interministerial Ordinance No. 28/2024 establishes the duties of these bodies in the process of analyzing applications for permits to operate fixed-odds betting.
In addition, the Ministry of Sport is given the power to define and keep up to date a public list of sports and sports entities that can be the subject of bets on real sporting events.
