On April 7, 2025, the Ministry of Sports (“MESP“) published the Rule No. 31/2025, to regulate the monitoring procedures for the electronic sites of authorized operators to exploit the fixed-odds lottery betting modality on real sports-themed events.

Under the new regulation, the National Secretariat for Sports Betting and Economic Development of Sports, linked to MESP, must (i) establish and (ii) coordinate a technical team whose function will be to periodically analyze the sites of sports betting operators.

In addition to verifying compliance with legal and regulatory requirements, the periodic analysis will focus on the following essential aspects:

  1. The verification of the regularity of the commercial brand used by the operator, to ensure correspondence with the brand registered in the Secretariat of Prizes and Betting of the Ministry of Finance (Secretaria de Prêmios e Apostas – “SPA/MF”) authorization process;
  2. The verification of the offer of sports modalities, to ensure they comply with the list of activities that can be subject to sports betting, detailed in MESP Ordinance No. 125/2024 and any updates;
  3. The identification of any practices that may constitute violations of current regulations, such as (i) offering prohibited bets; and (ii) the absence of effective mechanisms to prevent the participation of children and adolescents.

Any irregularities found by the technical team must be included in a report that will be sent to SPA/MF for the adoption of appropriate measures. Rule MESP No. 31/2025 also establishes that the Ministry of Sports may develop an integrity platform for the sector’s sports operations and may form partnerships with public and private entities with the aim of improving monitoring tools and processes.
