CADE’s tribunal quorum is restored and deadlines are resumed

After more than a month, the Tribunal of the Administrative Council for Economic Defense (“CADE“) now has the minimum quorum required to open its trial sessions. As a result, the procedural deadlines set out in Law no. 12.529/11, which had been suspended pursuant to Article 6 §5 of this law, are now resumed.

On December 27, the Federal Official Gazette published the appointment of the Court’s new members, José Levi Mello do Amaral Júnior, Camila Cabral Pires Alves, Diogo Thomson de Andrade and Carlos Jacques Vieira Gomes. On this same day, Diogo Thomson de Andrade took office as CADE’s Commissioner, thus restoring the minimum quorum of four members required for the Administrative Tribunal to function. Commissioner Diogo Thomson, who previously served as CADE’s Deputy Superintendent, now joins Alexandre Cordeiro Macedo, President of the Tribunal, and Commissioners Gustavo Augusto Lima and Victor Oliveira Fernandes. The other new commissioners should take office in the next days. The term of office for CADE’s commissioners is four years.

The first trial session of CADE’s Tribunal is already scheduled for February 7, 2024. For the time being, there are no extraordinary sessions scheduled for January.
