On March 27, 2026, at the 1,179th Meeting of the ANP Board of Directors, ANP Resolution 998/2026 was approved, which regulates the methodology for calculating the reference price applicable to the granting of economic subsidies for the sale of diesel fuel, established by Provisional Measure No. 1,340/2026 and regulated by Decree No. 12,878/2026.
The regulation establishes the formula for calculating the daily reference price, taking into account variations in Import Parity Prices, logistics differentials, and regional parameters, based on information from S&P Global Energy Platts and the dollar exchange rate published by the Central Bank of Brazil.
The Resolution also sets forth specific conditions for producers that refine their own domestic crude oil, establishing limits and adjustment mechanisms between the different reference prices to ensure consistency with the values set by the Ministry of Mines and Energy.
On March 31, 2026, the ANP published, via Order No. 464/2026, the mandatory individual targets to be met by fuel distributors in 2026 under the RenovaBio program, established by Law No. 13,576/2017.
The individual targets were calculated based on the annual mandatory target of 48.09 million CBIOs (Decarbonization Credits), established by CNPE Resolution No. 21/2025, for the year 2026.
Each distributor’s market share in the sale of fossil fuels was determined in accordance with the methodology set forth in Article 6 of ANP Resolution No. 791/2019, serving as the basis for defining individual obligations.
On April 6, 2026, Dispatch No. 519/2026 was published in the Federal Official Gazette (Diário Oficial da União), accrediting the first Origin Certification Agent (Agente Certificador de Origem – ACO) authorized to carry out the certification of biomethane producers for the purpose of issuing the Biomethane Certificate of Guarantee of Origin (Certificado de Garantia de Origem de Biometano – CGOB).
This is the first accreditation of an ACO following the publication of ANP Resolution No. 996/2026, which establishes the requirements and guidelines for accrediting these agents and regulates the certification of biomethane producers and importers, including the issuance of CGOBs and the procedures for generating the corresponding underlying attributes (“lastro”), among other provisions.
On April 10, 2026, during the 1,180th Board of Directors Meeting, the ANP approved the holding of Public Consultation and Public Hearing No. 06/2026 regarding the proposal to revise ANP Resolution No. 759/2018, which establishes criteria for differentiated treatment applied to microenterprises and small-sized enterprises in inspection activities conducted by the Agency and its affiliated entities.
At the same meeting, the Regulatory Impact Analysis (RIA) Report on the matter was also approved. This report provides the basis for the proposed revision of the regulation, together with the contributions gathered during a workshop held with industry stakeholders.
Among the main changes proposed in the draft resolution is a more detailed definition of the two‑stage inspection procedure, setting a single deadline of 40 calendar days for the corrective regularization of noncompliances between the first and second inspections. The text also expressly allows for the application of conduct-adjustment measures as an alternative to the issuance of an infringement notice. However, cases involving serious irregularities committed by micro and small enterprises remain excluded from the differentiated treatment, particularly those that involve a high risk to life, health, or public or third‑party property, such as fuel leaks and situations of direct and imminent danger.
The period for submitting contributions to the Public Consultation began on April 17 and will run until June 1, 2026, while the Public Hearing is scheduled for June 16, 2026, to be held from 2:00 p.m. to 5:00 p.m.
