ANTAQ Approves Regulatory Sandbox Manual<\/h2>\n\n\n\n

On 08\/13\/2026, ANTAQ published Ruling No. 457\/2026-ANTAQ<\/a>, approving the Regulatory Sandbox Manual<\/a> provided for under ANTAQ Resolution No. 131\/2025. The document governs the operation of the experimental environment designed for the temporary and controlled testing of innovative solutions in the waterway sector. The manual organizes the stages for project submission, selection, monitoring and closure, and provides guidance on defining the regulatory conditions applicable during the experimental period. Project implementation remains subject to the limits, monitoring obligations and other conditions established by ANTAQ.<\/p>\n\n\n\n

\n\n\n\n

ANTAQ Regulates the Authorization of Inland Navigation Transportation Services<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 136\/2026<\/a>, which establishes the technical, economic and financial, legal and tax-related criteria for obtaining authorization to provide inland navigation transportation services.<\/p>\n\n\n\n

The Resolution covers the longitudinal transportation of cargo, passengers, or both, as well as regular and private ferry services for passengers, vehicles, and cargo. Among other matters, it governs the submission and processing of applications for authorization, the required documents, the scope of authorization instruments, and the conditions for maintaining operations. It also allows the same vessel to be used on different routes and extends the deadline for commencing operations following the issuance of the authorization from 60 to 120 days. The Resolution will enter into force 180 days after its publication.<\/p>\n\n\n\n

ANTAQ Regulates Vessel Chartering in Inland Navigation<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 137\/2026<\/a>, which regulates the chartering by Brazilian Shipping Companies of Brazilian and foreign vessels intended for inland navigation. The Resolution governs voyage, space, time, and bareboat charter arrangements, in addition to defining the circumstances in which chartering does not require authorization from the Agency. With respect to foreign vessels, the Resolution details the market consultation and blocking procedures, establishes the time limits for consulting the domestic market, and sets out the conditions for issuing the Inland Charter Authorization Certificate (“AAI<\/strong>“). Key changes include a maximum advance period of 45 calendar days and a minimum advance period of three business days for conducting the market consultation, the requirement to provide justification for its cancellation after a blocking notice has been submitted, and a maximum period of 12 months for the chartering of a foreign vessel. The Resolution will enter into force 180 days after its publication.<\/p>\n\n\n\n

ANTAQ Establishes Rights and Obligations for Passenger, Mixed and Ferry Transportation<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 138\/2026<\/a>, which governs the provision of regular passenger or mixed transportation services on longitudinal routes and passenger and vehicle transportation services on ferry routes. The Resolution consolidates the rights and obligations of carriers and users, covering matters such as passenger identification, the issuance and use of passenger tickets, baggage transportation, and boarding and disembarkation conditions. It also governs the granting of fare exemptions provided for by law and the limits applicable to the reservation of seats for the respective beneficiaries. The regulation seeks to standardize the obligations applicable to the provision of these services, particularly with respect to passenger assistance, information transparency, and compliance with legally guaranteed fare benefits. The Resolution will enter into force 180 days after its publication.<\/p>\n\n\n\n

ANTAQ Establishes Obligations Applicable to Private Transportation in Inland Navigation<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 139\/2026<\/a>, which establishes the rights and obligations applicable to the private transportation of cargo, persons, and vehicles on longitudinal and ferry routes in inland navigation. The Resolution defines private transportation as a service provided for a fixed term, under a contract and against payment of an invoice, without being offered to the general public. In the transportation of persons, beneficiaries must have a direct and permanent relationship with the contracting party, including an employment, professional, or economic relationship. The Resolution also establishes obligations concerning vessel compliance and safety, the transportation of hazardous products, the maintenance of a vessel in commercial operation, and the reporting of accidents, registration changes, changes to the fleet, and the termination of activities. With respect to the private transportation of persons and vehicles, it also provides for information, boarding, disembarkation, and priority assistance procedures. The Resolution will enter into force 180 days after its publication.<\/p>\n\n\n\n

ANTAQ Establishes Procedures for Vessel Approval in the Brazilian Federal Revenue Service’s Systems<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 140\/2026<\/a>, which establishes the procedures for entering information and approving inland navigation vessels in the systems of the Brazilian Federal Revenue Service (“RFB<\/strong>“). The procedure is intended exclusively to enable the computerized customs control of the movement of vessels, cargo, and cargo units at bonded ports. The Resolution applies to companies operating exclusively in intermunicipal or municipal cargo transportation, as well as foreign companies whose vessels must be registered in the RFB’s systems. Approval is subject to the submission of the corporate, operational, and vessel ownership or use documents specified in the Resolution. The Resolution clarifies, however, that the procedure is strictly for registration purposes and neither replaces nor constitutes authorization from ANTAQ to provide transportation services. The Resolution will enter into force 180 days after its publication.<\/p>\n\n\n\n

ANTAQ Establishes a New Framework for Operational Agreements in Inland Navigation<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published ANTAQ Resolution No. 141\/2026<\/a>, which regulates the execution of operational agreements for cargo transportation in inland navigation. The agreements may involve the exchange of vessel space, the transfer of loaded barges for the formation of convoys, and the shared use of equipment. The Resolution requires these operations to comply with the principles of equivalence and reciprocity, with the aim of reducing operating costs and increasing transportation efficiency. The regulation establishes the minimum required content of the agreements, limits their term to one year, subject to renewal, and requires their submission to ANTAQ for approval at least 15 days in advance. It also governs agreements entered into with foreign companies, restricts the transportation of cargo between points within Brazilian territory by foreign vessels, and provides for penalties and fines applicable to operations that have not been approved or that are conducted in breach of the Resolution. ANTAQ Approves Bidding Documents for the IQI16 Terminal at the Port of Itaqui<\/h2>\n\n\n\n

On 08\/19\/2026, through Ruling No. 480\/2026-ANTAQ<\/a>, ANTAQ approved the publication of the public notice and other documents related to the bidding procedure for the lease of the IQI16 area, located within the Organized Port of Itaqui, in the State of Maranh\u00e3o. The area will be used for the handling and storage of solid mineral bulk cargo, particularly fertilizers, under a 25-year lease agreement. The project includes rules concerning the use of shared berthing infrastructure and competition-related conditions applicable to parties holding a market share exceeding 40% in the port complex. The approval allows the bidding procedure to proceed, subject to the determinations and adjustments established by ANTAQ’s Collegiate Board.<\/p>\n\n\n\n

ANTAQ Approves Manual of Procedures for the Circularization and Blocking of Vessels in Maritime Support Navigation<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published Ruling No. 487\/2026-ANTAQ<\/a>, through which its Board of Directors approved the Manual of Procedures for the Circularization and Blocking of Vessels in Maritime Support Navigation (the “Manual<\/strong>“). The Manual provides guidance on ANTAQ’s approach to circularization and blocking procedures conducted through the Maritime and Support Navigation Chartering System (the “SAMA<\/strong>“), pursuant to ANTAQ Resolution No. 129\/2025 and Law No. 9,432\/1997. Among other matters, the Manual addresses negotiations between the parties following a blocking request, response deadlines, SAMA system outages, the assessment of firm blocking requests and, when requested by either party, the verification of whether the proposed terms are consistent with reference prices in the Brazilian market. The Manual also addresses administrative appeals and conduct that may result in sanctioning proceedings.<\/p>\n\n\n\n

According to the Manual, its primary objective is to ensure priority for the Brazilian-flagged fleet while maintaining a sound competitive environment.<\/p>\n\n\n\n

ANTAQ Approves New Port Investment Monitoring System and Electronic Submission of RAPIR<\/h2>\n\n\n\n

On 08\/19\/2026, ANTAQ published Ruling No. 495\/2026-ANTAQ<\/a>, which approved the restructuring of the process for monitoring investments made in port facilities through the implementation of the Investment Monitoring System.<\/p>\n\n\n\n

The project includes the launch of an electronic module for receiving the Project and Investment Monitoring Report (“RAPIR<\/strong>“), designed to standardize the submission and monitoring of physical and financial information relating to investments subject to the Agency’s oversight.<\/p>\n\n\n\n
