{"id":32908,"date":"2026-07-10T17:31:57","date_gmt":"2026-07-10T20:31:57","guid":{"rendered":"https:\/\/lefosse.com\/?p=32908"},"modified":"2026-07-10T17:32:03","modified_gmt":"2026-07-10T20:32:03","slug":"oil-and-gas-decisions-of-the-anp-board-of-directors-june-2026","status":"publish","type":"post","link":"https:\/\/lefosse.com\/en\/noticias\/oil-and-gas-decisions-of-the-anp-board-of-directors-june-2026\/","title":{"rendered":"Oil And Gas | Decisions of the ANP Board of Directors | June 2026"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">ANP Approves Technical Report on CGOB Registrar Accreditation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On June 8, 2026, the ANP Board of Directors, through <a href=\"https:\/\/atosoficiais.com.br\/anp\/decisao-de-diretoria-n-361-2026-publicacao-de-informe-tecnico-com-procedimentos-para-credenciamento-de-escriturador-de-cgob?origin=instituicao\" type=\"link\" id=\"https:\/\/atosoficiais.com.br\/anp\/decisao-de-diretoria-n-361-2026-publicacao-de-informe-tecnico-com-procedimentos-para-credenciamento-de-escriturador-de-cgob?origin=instituicao\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Board Decision No. 361\/2026<\/mark><\/a>, approved <a href=\"https:\/\/sei.anp.gov.br\/sei\/modulos\/pesquisa\/md_pesq_documento_consulta_externa.php?bQdXWIUhq46-kuNuYYlAsyjFfu3aG4dBu2PjbFgpOb_9MvqFNtXlXEMWSYTBr1f7z0g5p97pRY7Jz5GItK4e8RcWfJcqxd8Tp3V96JzCkEsUDgwtjEbTa1la9t3AiVl8\" type=\"link\" id=\"https:\/\/sei.anp.gov.br\/sei\/modulos\/pesquisa\/md_pesq_documento_consulta_externa.php?bQdXWIUhq46-kuNuYYlAsyjFfu3aG4dBu2PjbFgpOb_9MvqFNtXlXEMWSYTBr1f7z0g5p97pRY7Jz5GItK4e8RcWfJcqxd8Tp3V96JzCkEsUDgwtjEbTa1la9t3AiVl8\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Technical Report No. 02\/CGOB<\/mark><\/a>, which establishes general guidelines for the accreditation of registrars for Biomethane Certificates of Origin (&#8220;CGOB&#8221;).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the technical report, the document aims to provide guidance to companies interested in acting as CGOB registrars, whose accreditation review will be the responsibility of the Energy Transition and RenovaBio Coordination Office (CTER), within the Superintendence of Technology and Environment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The document clarifies that accreditation may only be requested by a Certified Origin Agent (&#8220;ACO&#8221;) accredited by the ANP or by a legal entity authorized by the CVM, in accordance with the rules set forth in Articles 36 and 37 of ANP Resolution No. 996\/2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The notice also details the electronic filing procedure in the SEI system for submitting the application, including guidelines on completing the application, identifying the interested parties, and submitting the required documentation, such as the application form, power of attorney, identification document of the accredited representative, accreditation order as an ACO, and proof of registration with the CVM, where applicable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, the document stipulates that the accredited bookkeeper must keep its registration information up to date with the ANP and that, in the event of temporary suspension or cancellation of the company&#8217;s accreditation as an ACO, its accreditation as a CGOB bookkeeper will also be suspended until further approval.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ANP Suspends Regulatory Discussion on LPG to Prioritize Emergency Measures for Supply<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On June 12, 2026, at the 1,184th Meeting of the Board, the ANP Board of Directors approved the temporary suspension of Regulatory Action No. 4.8 of the 2025-2026 Regulatory Agenda, regarding the revision of ANP Resolutions No. 957\/2023 and No. 958\/2023, which govern the distribution and resale of LPG.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The measure aims to prioritize the execution of tasks related to emergency measures adopted in response to the impacts of the international context on the Brazilian fuel market, including subsidies for diesel, gasoline, and LPG, as well as the monitoring of potential abusive price increases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue had previously been scheduled for public consultation and hearings, during which proposals were presented to update the regulatory framework governing the distribution and resale of LPG. Among the changes under discussion are the elimination of brand loyalty requirements and the introduction of the role of &#8220;advanced LPG filler,&#8221; a new agent authorized to fill containers of up to 13 kg at smaller facilities. With this suspension, the processing of these proposals is temporarily halted, with no new timeline set, as of yet, for their resumption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same meeting, the ANP also suspended other actions on the 2025-2026 Regulatory Agenda, including the revision of ANP Resolution No. 795\/2019, which addresses the mandatory submission of price data related to the sale of petroleum products and biofuels by producers, importers, and distributors. Finally, the ANP emphasized that the suspension does not stem from these issues losing relevance, but rather from the need to align regulatory planning with exceptional institutional priorities &#8211; such as monitoring potential abusive price increases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ANP grants additional deadline for natural gas importers to comply with quality control rules<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On June 12, 2026, at its 1,184th Board of Directors Meeting, ANP approved, through <a href=\"https:\/\/atosoficiais.com.br\/anp\/decisao-de-diretoria-n-367-2026-concessao-de-prazo-aos-importadores-de-gas-natural-para-o-atendimento-ao-disposto-na-resolucao-anp-no-982-2025-e-na-resolucao-anp-no-828-2020?origin=instituicao\" type=\"link\" id=\"https:\/\/atosoficiais.com.br\/anp\/decisao-de-diretoria-n-367-2026-concessao-de-prazo-aos-importadores-de-gas-natural-para-o-atendimento-ao-disposto-na-resolucao-anp-no-982-2025-e-na-resolucao-anp-no-828-2020?origin=instituicao\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Board Decision No. 367\/2026<\/mark><\/a> the granting of an additional 90-day deadline for natural gas importers to bring their compliance with the quality control requirements set forth in <a href=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-982-2025-estabelece-as-especificacoes-do-gas-natural-nacional-ou-importado-e-as-obrigacoes-quanto-ao-controle-da-qualidade-a-serem-atendidas-pelos-agentes-economicos-que-comercializam-ou-transportam-o-produto-em-territorio-nacional?__cf_chl_f_tk=VcEey8IwXf9dvgbtd9t0xgKxkx.rfcKFxr2a.kbccfo-1782783388-1.0.1.1-zfWzpg92YMrU2YSwOumkAhnp8mcanFqXYyc_Nv.dlu0\" type=\"link\" id=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-982-2025-estabelece-as-especificacoes-do-gas-natural-nacional-ou-importado-e-as-obrigacoes-quanto-ao-controle-da-qualidade-a-serem-atendidas-pelos-agentes-economicos-que-comercializam-ou-transportam-o-produto-em-territorio-nacional?__cf_chl_f_tk=VcEey8IwXf9dvgbtd9t0xgKxkx.rfcKFxr2a.kbccfo-1782783388-1.0.1.1-zfWzpg92YMrU2YSwOumkAhnp8mcanFqXYyc_Nv.dlu0\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">ANP Resolutions No. 982\/2025<\/mark><\/a> and <a href=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-828-2020\" type=\"link\" id=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-828-2020\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">No. 828\/2020<\/mark><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This measure relates to the obligations to issue quality certificates for imported natural gas and to submit the corresponding information to the ANP, as introduced by ANP Resolution No. 982\/2025. On an exceptional basis, the Agency authorized compliance with these obligations within the additional time granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision also covers the submission of retroactive quality data for the period beginning June 1, 2025, through the &#8220;From Well to Station&#8221; system. According to the ANP, the measure is transitional in nature and aims to ensure the effectiveness of regulation and legal certainty in the sector.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ANP Approves Technical Study on the Fungibility of the CGOB<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On June 26, 2026, at its 1,185th Board Meeting,the ANP Board of Directors approved the Technical Study on the <a href=\"https:\/\/www.gov.br\/anp\/pt-br\/assuntos\/programa-incentivo-biometano\/arquivos-estudos-relatorios-e-seminarios\/relatoriofungibilidadecgob.pdf\" type=\"link\" id=\"https:\/\/www.gov.br\/anp\/pt-br\/assuntos\/programa-incentivo-biometano\/arquivos-estudos-relatorios-e-seminarios\/relatoriofungibilidadecgob.pdf\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Fungibility of the Biomethane Certificate of Guarantee of Origin (CGOB)<\/mark><\/a>. The report analyzes the possibility of recognizing and using the CGOB interchangeably with other environmental attribute certificates, within the context of <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2024\/lei\/l14993.htm\" type=\"link\" id=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2024\/lei\/l14993.htm\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Law No. 14,993\/2024<\/mark><\/a>, <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2025\/decreto\/d12614.htm\" type=\"link\" id=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2025\/decreto\/d12614.htm\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Decree No. 12,614\/2025<\/mark><\/a> and <a href=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-996-2026-regulamenta-a-certificacao-do-produtor-e-importador-de-biometano-com-vistas-a-emissao-do-certificado-de-garantia-de-origem-de-biometano-cgob-os-procedimentos-para-geracao-de-lastro-necessarios-para-emissao-primaria-de-cgob-o-credenciamento-de-agentes-certificadores-de-origem-e-da-outras-providencias?origin=instituicao\" type=\"link\" id=\"https:\/\/atosoficiais.com.br\/anp\/resolucao-n-996-2026-regulamenta-a-certificacao-do-produtor-e-importador-de-biometano-com-vistas-a-emissao-do-certificado-de-garantia-de-origem-de-biometano-cgob-os-procedimentos-para-geracao-de-lastro-necessarios-para-emissao-primaria-de-cgob-o-credenciamento-de-agentes-certificadores-de-origem-e-da-outras-providencias?origin=instituicao\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">ANP Resolution No. 996\/2026<\/mark><\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Between March and April, ANP launched a public consultation process to gather input from interested parties, to be taken into account in the preparation of the study. According to the ANP, submissions were received from 17 institutions, including representatives from academia, consulting firms, industry associations, companies in the natural gas and biomethane sectors, as well as certification and registration bodies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The study identified similarities between the CGOB and other environmental attribute certificates, but also significant differences regarding the nature of the certified attributes, methodologies, units of measurement, operational rules, audit and verification procedures, issuance and validity periods, and registration and cancellation systems. Due to these differences, the report concluded that equivalence between certificates should not be presumed, thereby ruling out automatic fungibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In ANP&#8217;s view, the fungibility of the CGOB is defined as &#8220;the possibility of regulated and conditional recognition of functional equivalence between distinct environmental attribute certificates, for specific purposes of use,&#8221; provided that the following requirements are cumulatively met: (i) identity of the certified environmental attribute (renewable origin of biomethane); (ii) material equivalence regarding the unit, reference period, and backing; (iii) full and auditable traceability of the certified volume; (iv) compatible governance between the certification and registration systems; and (v) the existence of effective cancellation\/retirement mechanisms capable of preventing double counting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this context, the study concluded that the current regulatory framework already establishes the basis for a &#8220;fungibility through validation&#8221; model, rather than &#8220;automatic equivalence,&#8221; recommending the full retention of ANP Resolution No. 996\/2026 and the evaluation of any adjustments only after the market has matured further, including within the scope of the Regulatory Outcome Assessment to be conducted by ANP in three years.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ANP approves criteria for characterizing abusive fuel price increases<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">On June 30, 2026, during ANP Extraordinary Board Meeting No. 70, ANP&#8217;s Board unanimously approved two resolutions establishing criteria for characterizing abusive fuel price increases. The rules apply separately to retail dealers of liquid fuels and LPG, and to distributors of liquid fuels and LPG, but have not yet been published in the Federal Official Gazette.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The adopted methodology uses gross margin as the parameter for analysis, comparing margins applied by the same economic agent in different periods. According to ANP, the criterion seeks to assess variations against the agent&#8217;s own usual pricing pattern, while also considering the pass-through of any cost increases in earlier stages of the supply chain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Initially, the drafts released under <a href=\"https:\/\/www.gov.br\/anp\/pt-br\/assuntos\/consultas-e-audiencias-publicas\/consulta-audiencia-publica\/2026\/consulta-e-audiencia-publicas-no-12-2026\" type=\"link\" id=\"https:\/\/www.gov.br\/anp\/pt-br\/assuntos\/consultas-e-audiencias-publicas\/consulta-audiencia-publica\/2026\/consulta-e-audiencia-publicas-no-12-2026\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Public Consultation No. 12\/2026<\/mark><\/a> provided that &#8220;abusiveness&#8221; could potentially be characterized during periods of geopolitical conflict or calamity when the gross margin of distributors and retailers increased by 10% or more. In such cases, ANP could grant companies up to 10 calendar days to demonstrate the absence of abusive price increases. In the approved resolutions, ANP took into account the contributions submitted by market participants, increasing the gross margin threshold to 70% and extending the deadline for submitting a defense to 30 calendar days. The resolutions establish, as an initial screening criterion in situations of geopolitical conflict or calamity, a 70% increase in gross margin. In such cases, the agent may be notified to submit, within 30 days, documents justifying the cost variation. If the justification is deemed sufficient, the conduct will not be characterized as abusive. However, if the justification is not accepted, a notice of violation may be issued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rules stem from <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2026\/mpv\/mpv1340.htm\" type=\"link\" id=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2026\/mpv\/mpv1340.htm\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Provisional Measures No. 1,340\/2026<\/mark><\/a> and <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2026\/mpv\/mpv1349.htm\" type=\"link\" id=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2026\/mpv\/mpv1349.htm\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">No. 1,349\/2026<\/mark><\/a>, which assigned ANP responsibility for overseeing abusive fuel price increases and classified the conduct of &#8220;abusively increasing the prices of fuels, biofuels and petroleum products&#8221; as an administrative offense under Article 3, item XXI, of <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9847.htm\" type=\"link\" id=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9847.htm\"><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-purple-color\">Law No. 9,847\/1999<\/mark><\/a>, subject to penalties ranging from BRL 50,000.00 to BRL 500,000,000.00.
